The rule will require that workers be considered employees rather than contractors when they are &#8220;economically dependent&#8221; on a company. The final rule rescinds the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2021-01-07\/pdf\/2020-29274.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #0082c0; text-decoration: underline;\">2021 Independent Contractor Rule<\/span><\/a><\/span> and replaces it. It largely mirrors the agency\u2019s October 2022 <a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/10\/13\/2022-21454\/employee-or-independent-contractor-classification-under-the-fair-labor-standards-act\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline; color: #0082c0;\">proposed<\/span><\/a> rule, adopting a six-factor, \u201ctotality-of-the-circumstances\u201d framework for analyzing worker-employer relationships.<\/p>\n<p>The DOL will consider six factors when examining the relationship between a worker and a potential employer:<\/p>\n<ul>\n<li>Worker\u2019s opportunity for profit or loss.<\/li>\n<li>Investments made by the worker and the employer.<\/li>\n<li>Degree of permanence of the work relationship.<\/li>\n<li>Nature and degree of control over performance of the work.<\/li>\n<li>Extent to which the work performed is an integral part of the employer\u2019s business.<\/li>\n<li>Use of the worker\u2019s skill and initiative.<\/li>\n<\/ul>\n<p>The rule will be published in the Federal Register on January 10, and will take effect March 11.
