Police came into the paper\u2019s offices and the home of its co-owner and seized the paper\u2019s electronic devices and files. The raid quickly made national and international headlines, sending shock waves throughout the free press community. Why had police raided the premises? Was the raid legal? \u00a0What does this mean for our free and independent press? These questions and more swirled around this unusual event.<\/p>\n<p>The News\/Media Alliance quickly condemned the raid, along with numerous other organizations, in a <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/www.rcfp.org\/wp-content\/uploads\/2023\/08\/2023-08-13-Marion-County-Record-police-raid-letter.pdf\" target=\"_blank\" rel=\"noopener\">letter<\/a><\/span> led by Reporters Committee for Freedom of the Press (RCFP). In the days and weeks following the raid, we know the answers to many questions, but some remain unanswered, such as: What lasting impact will the raid have on the independence of the free press in this country?<\/p>\n<p>As <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/kansasreflector.com\/2023\/08\/11\/police-stage-chilling-raid-on-marion-county-newspaper-seizing-computers-records-and-cellphones\/\" target=\"_blank\" rel=\"noopener\">reported<\/a><\/span>, the raid was conducted in response to a local restaurant owner\u2019s claim that a reporter at the paper had allegedly committed identify theft in accessing her driving record. In fact, we now know the reporter accessed <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/kansasreflector.com\/2023\/08\/30\/kansas-reporter-sues-marion-police-chief-alleging-retaliation-in-newsroom-raid\/?emci=4723434f-f647-ee11-a3f1-00224832eb73&amp;emdi=31733e1b-0e48-ee11-a3f1-00224832eb73&amp;ceid=41100\" target=\"_blank\" rel=\"noopener\">public records<\/a><\/span> on a public website in order to verify a tip she received from a confidential source. Five days after the raid, after much public outcry, the warrant was <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/www.washingtonpost.com\/media\/2023\/08\/26\/marion-county-newspaper-police-raid-what-really-happened\/\" target=\"_blank\" rel=\"noopener\">withdrawn<\/a><\/span> and the paper\u2019s equipment returned. While some may read this and think, \u201cNo harm, no foul,\u201d unfortunately this couldn\u2019t be further from the truth.<\/p>\n<h4><span style=\"color: #828a8f;\"><strong>Here are three reasons why this raid is no small-fry matter, and why every American should be alarmed:<\/strong><\/span><\/h4>\n<p><strong>1)\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0The Press Rely on Protection of the Law to Keep Government Accountable<\/strong><\/p>\n<p>The press has long operated as an unofficial watchdog of government, uncovering misconduct and corruption through investigative journalism, and keeping the public informed of government actions. Journalists are only able to do this, however, if they can rely on laws designed to protect them from government overreach or abuse of power. Most states have press shield laws (something still needed on the <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/www.newsmediaalliance.org\/statement-bipartisan-federal-shield-bill-the-protect-reporters-from-excessive-state-suppression-press-act-reintroduced-in-house-and-senate\/\">Federal level<\/a><\/span>), such as the Kansas Shield Law, which should have protected the <em>Marion County Record<\/em> from a raid, providing for a subpoena instead of a raid. The raid broke several norms, and the broad seizure of equipment caused the paper to almost shut down its operations. A reporter at the paper has filed a <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/kansasreflector.com\/2023\/08\/30\/kansas-reporter-sues-marion-police-chief-alleging-retaliation-in-newsroom-raid\/?emci=4723434f-f647-ee11-a3f1-00224832eb73&amp;emdi=31733e1b-0e48-ee11-a3f1-00224832eb73&amp;ceid=41100\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a><\/span> against the police chief, claiming her First Amendment rights were violated, and alleging the raid was intended to \u2018punish the journalists for investigating and reporting news stories.\u2019<\/p>\n<p><strong>2)\u00a0\u00a0\u00a0\u00a0\u00a0 Police Raids Have a Chilling Effect on Journalists and Sources<\/strong><\/p>\n<p>If the government can infringe upon the rights of the free press, raid their premises and search through confidential source materials, this can have rippling effects \u2013 chilling not only the investigative work of journalists, but also deterring sources from coming forward. In the <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/kansasreflector.com\/2023\/08\/20\/inside-marion-county-record-sting-of-loss-and-a-warning-for-american-journalism-remains\/\" target=\"_blank\" rel=\"noopener\">words<\/a><\/span> of Eric Meyer, owner of the <em>Marion County Record<\/em>, \u201cit would be the end of people ever being able to send anything anonymously to a newspaper.\u201d Our democracy relies heavily upon the freedom of the press. Without it, America begins to resemble countries like Russia or North Korea, where the government routinely raids news organizations, intimidates reporters, and exposes confidential sources precisely to silence the press and anyone who helps uncover truths.<\/p>\n<p><strong>3)\u00a0\u00a0\u00a0\u00a0\u00a0 The Human Impact of this Event Cannot Be Understated<\/strong><\/p>\n<p>Tragically, the paper\u2019s co-owner, 98-year-old Joan Meyer, <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/www.nytimes.com\/2023\/08\/15\/business\/media\/joann-meyer-dead.html\" target=\"_blank\" rel=\"noopener\">collapsed and died<\/a><\/span> just one day after her home was searched as part of the raid. The coroner determined that the stress of the search was a <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/www.nytimes.com\/2023\/08\/15\/business\/media\/joann-meyer-dead.html\" target=\"_blank\" rel=\"noopener\">contributing factor<\/a><\/span> to her death. Her son and now sole owner Eric Meyer <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/kansasreflector.com\/2023\/08\/19\/co-owner-of-kansas-newspaper-who-died-amid-stress-from-police-raid-honored-in-funeral-service\/\" target=\"_blank\" rel=\"noopener\">said<\/a><\/span> in an interview, \u201cSo the last 24 hours of a 98-year-old woman\u2019s life was devoted to pain and anguish, and a feeling that all her life didn\u2019t matter.\u201d Beyond this personal and unnecessary tragedy, a raid on a news organization breeds mistrust in the press and law enforcement and can splinter communities, especially in small towns such as <span style=\"text-decoration: underline; color: #0082c0;\"><a style=\"color: #0082c0; text-decoration: underline;\" href=\"https:\/\/youtu.be\/gGRuleBjnKk?si=bK4cH1ZvdSCRG1lK&amp;t=105\" target=\"_blank\" rel=\"noopener\">Marion County<\/a><\/span>.<\/p>\n<p>The impact this raid will have on American journalism going forward is yet to be seen. That will largely depend on how strongly the community at large condemns such raids and what if any accountability arises from it.
