{"id":12744,"date":"2022-07-11T11:54:17","date_gmt":"2022-07-11T15:54:17","guid":{"rendered":"https:\/\/www.newsmediaalliance.org\/?p=12744"},"modified":"2025-02-07T15:38:57","modified_gmt":"2025-02-07T20:38:57","slug":"alliance-opposes-bill-restricting-journalists-right-of-access","status":"publish","type":"post","link":"https:\/\/www.newsmediaalliance.org\/alliance-opposes-bill-restricting-journalists-right-of-access\/","title":{"rendered":"Alliance Opposes Bill Restricting Journalists\u2019 Right of Access"},"content":{"rendered":"<p><iframe loading=\"lazy\" src=\"https:\/\/share.listnr.tech\/embed\/voiceover\/62cc4789a29bfb001d7f5143\" width=\"100%\" height=\"165\" frameborder=\"no\" scrolling=\"no\" seamless=\"\"><\/iframe><br \/>\nOn July 5, the Alliance <a href=\"https:\/\/nppa.org\/sites\/default\/files\/HB%202319%20Veto%20Letter%2006-30-22%5B2%5D.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline; color: #0082c0;\">joined a letter<\/span><\/a> by the National Press Photographers Association (NPPA) asking Arizona Governor Douglas Ducey to veto <a href=\"https:\/\/www.azleg.gov\/legtext\/55leg\/2R\/bills\/HB2319P.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline; color: #0082c0;\">HB 2319<\/span><\/a>\u2014a recently passed Bill that makes it illegal to film a law enforcement officer within eight feet of the officer without permission. The letter explains that the bill likely \u201cviolates not only the free speech and press clauses of the First Amendment\u201d and also \u201cruns counter to the \u2018clearly established right\u2019 to photograph and record police officers performing their official duties in a public place\u201d which is the controlling precedent in the Ninth Circuit that includes Arizona. In February, the Alliance <a href=\"https:\/\/www.newsmediaalliance.org\/alliance-joins-letter-opposing-prohibition-on-recording-police\/\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline; color: #0082c0;\">joined another<\/span><\/a> NPPA letter asking the Arizona legislature to oppose HB 2319 and highlighted the serious constitutional concerns with a law restricting the right to record law enforcement. Unfortunately, the Arizona legislature passed the Bill, and on July 6, Governor Ducey signed the Bill into law. The Alliance is monitoring the situation in Arizona and is actively looking for ways to support journalists\u2019 First Amendment right to record law enforcement. <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2022\/07\/07\/arizona-recording-police-illegal\/10009423002\/\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline; color: #0082c0;\">Read more<\/span><\/a>.<\/p>\n<hr \/>\n<p><span style=\"color: #241f21;\"><strong>Update:<\/strong> <\/span>On July 21, 2023, a federal judge in Arizona <span style=\"color: #0082c0;\"><a style=\"color: #0082c0;\" href=\"https:\/\/embed.documentcloud.org\/documents\/23884700-ruling\/?embed=1&amp;responsive=1&amp;title=1\" target=\"_blank\" rel=\"noopener\">ruled<\/a><\/span> that the law to limit how close people can get to record law enforcement is unconstitutional. U.S. District Court Judge John J. Tuchi said in his ruling that the law violated the First Amendment and \u201cthere is a clearly established right to record law enforcement officers engaged in the exercise of their official duties in public places.\u201d This ruling permanently blocks enforcement of the law that Judge Tuchi had <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.azd.1307734\/gov.uscourts.azd.1307734.43.0.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;
